 {"id":2034,"date":"2016-01-11T19:20:52","date_gmt":"2016-01-11T19:20:52","guid":{"rendered":"https:\/\/live-journal-of-law-and-public-policy.pantheonsite.io\/?p=2034"},"modified":"2016-01-11T19:20:52","modified_gmt":"2016-01-11T19:20:52","slug":"is-daily-fantasy-sports-gambling","status":"publish","type":"post","link":"https:\/\/publications.lawschool.cornell.edu\/jlpp\/2016\/01\/11\/is-daily-fantasy-sports-gambling\/","title":{"rendered":"Is Daily Fantasy Sports Gambling?"},"content":{"rendered":"<span style=\"font-weight: 400\">In August of 2015, Forbes published an <\/span><a href=\"http:\/\/www.forbes.com\/sites\/williamnoglows\/2015\/08\/14\/draftkings-vs-fanduel-tale-of-the-tape\/\"><span style=\"font-weight: 400\">article<\/span><\/a><span style=\"font-weight: 400\"> highlighting the fast-growing daily fantasy sports (DFS) industry. The rise of fantasy sports and most specifically fantasy football has been truly remarkable. In recent years, fantasy football has absolutely <\/span><a href=\"http:\/\/www.forbes.com\/sites\/leighsteinberg\/2014\/08\/29\/the-fantasy-football-explosion\/http:\/\/www.forbes.com\/sites\/leighsteinberg\/2014\/08\/29\/the-fantasy-football-explosion\/\"><span style=\"font-weight: 400\">exploded<\/span><\/a><span style=\"font-weight: 400\"> with over 30 million Americans playing fantasy football annually. Fueled by over one billion dollars in <\/span><span style=\"font-weight: 400\">venture capital<\/span><span style=\"font-weight: 400\"> and powered by the internet, fantasy football has been rapidly evolving. It is this evolution that has, in many ways, shaped the controversy surrounding daily fantasy sports sites.<\/span>\n\n<span style=\"font-weight: 400\"><strong>Traditional Fantasy Sports<\/strong>:<\/span>\n\n<a href=\"http:\/\/sports.espn.go.com\/fantasy\/football\/ffl\/story?page=nfldk2k10howtoplay\"><span style=\"font-weight: 400\">Traditional fantasy<\/span><\/a><span style=\"font-weight: 400\"> football gives players a chance to serve as team owners\/managers and compete in a \u201cleague\u201d of friends. The fantasy season begins with a \u201cdraft\u201d process where each participant is permitted to select players for their team. In the standard league, each \u201cowner\u201d is required to fill a team roster. Each week of the football season, owners are matched up against an opposing owner. Points are then allocated based on various athletic achievements made by the players on their team. The winner of the weekly matchup is the team with the most points. The challenges continue until a winner is declared at the end of the football season.<\/span>\n\n<span style=\"font-weight: 400\">In 2006, Congress passed the <\/span><span style=\"font-weight: 400\">Internet Gambling Prohibition and Enforcement Act<\/span><span style=\"font-weight: 400\">. At the time, Fantasy Sports were played as traditional season-long competitions with very low financial stakes. As a result, the legislation\u2019s definitions section carved out an <\/span><a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/31\/5362\"><span style=\"font-weight: 400\">exception<\/span><\/a><span style=\"font-weight: 400\">, which permitted fantasy sports. This was largely based on the theory that fantasy success involves a requisite level of skill, distinguishing the activity from gambling. However, this legislative carve out was established prior to the rise of daily fantasy.<\/span>\n\n<strong>Daily Fantasy Sports (DFS)<\/strong><span style=\"font-weight: 400\">:<\/span>\n\n<span style=\"font-weight: 400\">Much like traditional fantasy sports, <\/span><a href=\"http:\/\/www.sbnation.com\/2015\/11\/24\/9791608\/draftkings-fanduel-daily-fantasy-sports-lawsuit-new-york-internet-gambling\"><span style=\"font-weight: 400\">daily fantasy games<\/span><\/a><span style=\"font-weight: 400\"> allow participants to act as team owners who select individual athletes for their teams. Daily match ups however, have much shorter durations; \u2018daily\u2019 fantasy events take place over a period of less than one week, often occurring over a single day. Additionally, entry fees for these contests can <\/span><a href=\"http:\/\/blogs.wsj.com\/law\/2015\/11\/20\/daily-fantasy-sports-games-of-luck-of-skill\/\"><span style=\"font-weight: 400\">exceed $10,000<\/span><\/a><span style=\"font-weight: 400\">. Thanks to hundreds of millions in <\/span><a href=\"http:\/\/www.businessinsider.com\/draftkings-fanduel-daily-fantasy-sports-advertising-2015-10\"><span style=\"font-weight: 400\">advertising money<\/span><\/a><span style=\"font-weight: 400\">, these daily fantasy matches have become extraordinarily popular.<\/span>\n\n<strong>Controversy Surrounding DFS<\/strong><span style=\"font-weight: 400\">:<\/span>\n\n<span style=\"font-weight: 400\">In recent months, the world of Daily Fantasy Sports has been riddled with controversy and legal concerns. From <\/span><a href=\"http:\/\/www.klgates.com\/is-money-being-laundered-through-your-financial-institution-using-daily-fantasy-sports-sites-10-29-2015\/\"><span style=\"font-weight: 400\">Money Laundering Concerns<\/span><\/a><span style=\"font-weight: 400\"> to a highly publicized <\/span><a href=\"http:\/\/www.nytimes.com\/2015\/10\/12\/sports\/fantasy-sports-draftkings-fanduel-insiders-edge-football.html?_r=1\"><span style=\"font-weight: 400\">Insider Scandal<\/span><\/a><span style=\"font-weight: 400\">, DFS has presented a growing list of potential issues. Amid these growing concerns, regulators have begun to consider whether the evolved \u2018daily fantasy\u2019 constitutes unlawful gambling, ineligible for legislative carve out. Most notably, on November 10, 2015 the New York State Attorney General issued a cease-and-desist order to <\/span><a href=\"http:\/\/www.nytimes.com\/interactive\/2015\/11\/10\/sports\/document-final-nyag-fanduel-letter-11-10-2015-signed.html\"><span style=\"font-weight: 400\">FanDuel<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"http:\/\/www.nytimes.com\/interactive\/2015\/11\/10\/sports\/document-final-nyag-draftkings-letter-11-10-2015.html\"><span style=\"font-weight: 400\">DraftKings<\/span><\/a><span style=\"font-weight: 400\">,<\/span><span style=\"font-weight: 400\"> ordering them to <\/span><a href=\"http:\/\/www.nytimes.com\/2015\/11\/11\/sports\/football\/draftkings-fanduel-new-york-attorney-general-tells-fantasy-sites-to-stop-taking-bets-in-new-york.html?smid=tw-bna&amp;_r=0\"><span style=\"font-weight: 400\">stop taking entries in New York<\/span><\/a><span style=\"font-weight: 400\">.  <\/span>\n\n<span style=\"font-weight: 400\">The story is evolving quickly. On December 11, 2015, New York Supreme Court Justice Manuel Mendez granted Attorney General Eric Schneiderman\u2019s request for a <\/span><a href=\"http:\/\/www.usatoday.com\/story\/sports\/nfl\/2015\/12\/11\/new-york-draftkings-fanduel-judge-injunctions\/76976010\/\"><span style=\"font-weight: 400\">preliminary injunction<\/span><\/a><span style=\"font-weight: 400\"> against FanDuel and DraftKings.  A challenge to the preliminary injunction was immediately filed and later that same day, appellate Justice Paul G. Feinman granted a <\/span><a href=\"http:\/\/www.usatoday.com\/story\/sports\/fantasy\/2015\/12\/11\/new-york-draftkings-fanduel-daily-fantasy-stay\/77170664\/\"><span style=\"font-weight: 400\">stay on the injunction<\/span><\/a><span style=\"font-weight: 400\">. This stay will allow the two sites to continue to operate in New York, at least until the first week of January 2016 (when they will appear in front of a full panel of judges).<\/span>\n\n<strong>DFS: Skill or Chance?<\/strong>\n\n<span style=\"font-weight: 400\">Attorney General Schneiderman\u2019s <\/span><a href=\"http:\/\/online.wsj.com\/public\/resources\/documents\/2015_1117_schneiderman_injunction.pdf\"><span style=\"font-weight: 400\">argument<\/span><\/a><span style=\"font-weight: 400\"> identifies the key question facing the court: does daily fantasy include a \u201cmaterial degree\u201d of chance\/luck so as to constitute a game of chance rather than a game of skill? Some insiders, like <\/span><a href=\"http:\/\/video.cnbc.com\/gallery\/?video=3000433118\"><span style=\"font-weight: 400\">NFL legend Joe Namath<\/span><\/a><span style=\"font-weight: 400\">, <\/span><a href=\"http:\/\/www.cnbc.com\/2015\/10\/02\/online-poker-vs-daily-fantasy-which-creates-more-winners.html\"><span style=\"font-weight: 400\">poker professional Andy Frankenberger<\/span><\/a><span style=\"font-weight: 400\"> and television host <\/span><a href=\"http:\/\/nymag.com\/daily\/intelligencer\/2015\/11\/john-oliver-talks-about-daily-fantasy-sports.html\"><span style=\"font-weight: 400\">John Oliver<\/span><\/a><span style=\"font-weight: 400\">,<\/span><span style=\"font-weight: 400\"> think the answer is clear \u2013 daily fantasy is gambling. Proponents of this viewpoint point to the impact DFS has on <\/span><a href=\"http:\/\/www.nytimes.com\/2015\/11\/23\/sports\/fantasy-sports-addiction-gambling-draftkings-fanduel.html\"><span style=\"font-weight: 400\">gambling addicts<\/span><\/a><span style=\"font-weight: 400\"> and instances where a single <\/span><a href=\"http:\/\/www.chicagotribune.com\/sports\/football\/bears\/ct-jay-cutler-costly-daily-fantasy-20k-new-york-20151118-story.html\"><span style=\"font-weight: 400\">athlete\u2019s strategic decision<\/span><\/a><span style=\"font-weight: 400\"> (outside of the fantasy player\u2019s control) has a costly impact on fantasy outcomes.<\/span>\n\n<span style=\"font-weight: 400\">On the other hand, there are skilled players who spend their entire day \u2018working\u2019 on their rosters with <\/span><a href=\"http:\/\/www.bloomberg.com\/news\/articles\/2015-09-10\/you-aren-t-good-enough-to-win-money-playing-daily-fantasy-football\"><span style=\"font-weight: 400\">great success<\/span><\/a><span style=\"font-weight: 400\"> thanks to carefully crafted predictive algorithms and data modeling. And the group of successful fantasy professionals is very small relative to the overall fantasy user base; for instance, in the first half of the 2015 Major League Baseball (MLB) season, 1.3% of the fantasy players took home 91% of the DFS profits, suggesting skilled players are incredibly <\/span><a href=\"http:\/\/www.sportsbusinessdaily.com\/Journal\/Issues\/2015\/07\/27\/Opinion\/From-the-Field-of-Fantasy-Sports.aspx\"><span style=\"font-weight: 400\">advantaged<\/span><\/a><span style=\"font-weight: 400\">. In an interview with Fortune, DraftKings lawyer, <\/span><a href=\"http:\/\/fortune.com\/2015\/11\/24\/draftkings-david-boies-strategy\/\"><span style=\"font-weight: 400\">David Boies, demonstrated confidence<\/span><\/a><span style=\"font-weight: 400\"> in the legal merits of his client\u2019s position noting the level of skill necessary to succeed in daily fantasy.<\/span>\n\n<span style=\"font-weight: 400\">Yet a win in court may still have negative implications on the daily fantasy industry. As University of Georgia Professor, Jeffrey Dofman points out in an <\/span><a href=\"http:\/\/www.forbes.com\/sites\/jeffreydorfman\/2015\/12\/01\/how-daily-fantasy-sports-could-prove-theyre-legal-and-lose-all-their-customers\/\"><span style=\"font-weight: 400\">opinion piece for Forbes<\/span><\/a><span style=\"font-weight: 400\"> \u201c<\/span><span style=\"font-weight: 400\">Potentially, [DraftKings and FanDuel] could prove their games are legal at the same time as they kill their business model. Providing clear statistical evidence of the skill involved in these games might also serve to educate the general public how little chance they have of actually winning.<\/span><span style=\"font-weight: 400\">\u201d Moreover, subsequent legislative action could restrict or further regulate the daily fantasy industry.  <\/span>\n\n<span style=\"font-weight: 400\">No one can say definitively what will happen in the coming months but one thing is for sure, the stakes are high. The ultimate conclusion to the New York State litigation will likely have far reaching <\/span><a href=\"http:\/\/www.bloomberg.com\/news\/articles\/2015-12-11\/daily-fantasy-sites-back-in-business-in-new-york-after-appeal\"><span style=\"font-weight: 400\">implications<\/span><\/a><span style=\"font-weight: 400\"> across the country. Thus for the time being, the controversy surrounding daily fantasy will undoubtedly remain a hot topic at the intersection of law, business, sports, and <\/span><a href=\"http:\/\/www.cnbc.com\/2015\/10\/28\/jeb-bush-daily-fantasy-sports-is-day-trading.html\"><span style=\"font-weight: 400\">politics<\/span><\/a><span style=\"font-weight: 400\">.<\/span>\n\n&nbsp;\n\n&nbsp;","protected":false},"excerpt":{"rendered":"<p>In August of 2015, Forbes published an article highlighting the fast-growing daily fantasy sports (DFS) industry.
