For those living in city centers, it is an unignorable issue. A home is\na foundation on which people build their lives\u2014losing the place you call home\ncan have serious impacts on one\u2019s ability to obtain <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/books\/NBK218240\/\"><em>financial stability<\/em><\/a> and can have\nimpacts on one\u2019s <a href=\"https:\/\/ighhub.org\/understanding-homelessness\/impact-mental-health#:~:text=Homelessness%2C%20in%20turn%2C%20amplifies%20poor,depression%2C%20sleeplessness%20and%20substance%20use.\"><em>mental health<\/em><\/a>. When the\nCOVID-19 (\u201cCOVID\u201d) pandemic hit American shores, it not only devastated the\nhealth of communities but also their <a href=\"https:\/\/www.pewresearch.org\/fact-tank\/2020\/06\/11\/unemployment-rose-higher-in-three-months-of-covid-19-than-it-did-in-two-years-of-the-great-recession\/\"><em>financial stability<\/em><\/a>,\nspecifically impacting communities of color more severely.<\/p>\n\n\n\n<p>During the hardest\nhit months of the pandemic, over <a href=\"https:\/\/www.pewresearch.org\/fact-tank\/2020\/06\/11\/unemployment-rose-higher-in-three-months-of-covid-19-than-it-did-in-two-years-of-the-great-recession\/\"><em>fourteen million Americans<\/em><\/a>\nfiled for unemployment. This spike in unemployment meant families lost the\nability to financially provide for themselves, and for many of them, the debt\nof every day expenses, such as <a href=\"https:\/\/www.ncsha.org\/wp-content\/uploads\/Analysis-of-Current-and-Expected-Rental-Shortfall-and-Potential-Evictions-in-the-US_Stout_FINAL.pdf#page=4\"><em>rent, began to accumulate<\/em><\/a>.\nThe looming threat of eviction hangs over many of these families who worry that\nthey will be just another homeless statistic. <\/p>\n\n\n\n<p>This piece explores\nthe eviction moratoriums the federal government and the New York state\ngovernment put in place and analyzes the protections they provide to tenants.\nIt is important to note that any protections offered <em>are <\/em><a href=\"https:\/\/www.nlc.org\/article\/2020\/08\/07\/long-term-approaches-to-preventing-evictions-now-and-beyond-covid-19\/\"><em>temporary<\/em><\/a>. A long-term\nsolution is needed to prevent mass evictions from taking place at some point in\nthe future. <\/p>\n\n\n\n<p><br><strong>I. New York State Law<\/strong><\/p>\n\n\n\n<p><em>Original Moratorium<\/em><\/p>\n\n\n\n<p>On March 20, 2020, Governor Andrew Cuomo signed into law <a href=\"https:\/\/www.governor.ny.gov\/news\/no-2028-continuing-temporary-suspension-and-modification-laws-relating-disaster-emergency\"><em>Executive Order No. 202.8<\/em><\/a>: Continuing Temporary Suspension and Modification of Laws Relating to the Disaster Emergency. This <a href=\"https:\/\/www.governor.ny.gov\/news\/no-2028-continuing-temporary-suspension-and-modification-laws-relating-disaster-emergency\"><em>order<\/em><\/a> responds directly to eviction proceedings: \u201cThere shall be no enforcement of either an eviction of any tenant residential or commercial, or a foreclosure of any residential or commercial property for a period of ninety days.\u201d The language in this order was quite expansive, as it did not differentiate between <a href=\"http:\/\/www.itkowitz.com\/itkowitztv\/lteatimewithmichelle1\"><em>non-payment versus holdover evictions<\/em><\/a>. A holdover eviction takes place when a lease has ended and the tenant refuses to vacate the property, while a non-payment eviction is filed when a tenant does not pay their rent. This meant that New York did not enforce evictions against its residents. Many tenants groups felt that the order <a href=\"https:\/\/www.politico.com\/states\/new-york\/albany\/story\/2020\/03\/20\/tenant-groups-say-eviction-moratorium-falls-short-as-calls-grow-to-halt-rent-payments-1268456\"><em>did not go far enough<\/em><\/a> since it only suspended evictions for three months and, even then, it was clear that the pandemic had no expiration date in sight. There was also a <a href=\"https:\/\/www.politico.com\/states\/new-york\/albany\/story\/2020\/03\/20\/tenant-groups-say-eviction-moratorium-falls-short-as-calls-grow-to-halt-rent-payments-1268456\"><em>glaring problem<\/em><\/a>: what happens when the moratorium ends? <\/p>\n\n\n\n<p><em>Moratorium Extension <\/em><\/p>\n\n\n\n<p>In May 2020, it\nwas clear that the pandemic was <a href=\"https:\/\/www.npr.org\/2020\/05\/27\/860508864\/we-all-feel-at-risk-100-000-people-dead-from-covid-19-in-the-u-s\"><em>not going anywhere<\/em><\/a><em> <\/em>and that the original\nexecutive order was insufficient to meet the needs of New Yorkers. This first\nled to Governor Cuomo <a href=\"https:\/\/www.wgrz.com\/article\/news\/health\/coronavirus\/gov-cuomo-nys-extends-eviction-moratorium-until-august-20-rent-relief-covid-19-coronavirus\/71-2dfa1d34-41d7-4e4e-9e66-2928617ab345\"><em>extending the moratorium<\/em><\/a>\nuntil August 20, 2020. The extension still prohibited the \u201c<a href=\"https:\/\/www.governor.ny.gov\/news\/no-20228-continuing-temporary-suspension-and-modification-laws-relating-disaster-emergency\"><em>initiation of a proceeding or\nenforcement<\/em><\/a>\u201d of an eviction, but the language seemed to limit it\nto evictions that stemmed only from nonpayment of rent. Specifically, the added\nlanguage is relevant because it seems to insinuate that the moratorium does not\napply to holdover evictions. This did not end up having a substantial impact\nbecause an <a href=\"https:\/\/www.nycourts.gov\/whatsnew\/pdf\/Rev_Ev_8_12.pdf\"><em>administrative order<\/em><\/a>\nmaintained the suspension of all eviction proceedings initiated after March 17.<\/p>\n\n\n\n<p><em>Tenants Safe Harbor Act<\/em><\/p>\n\n\n\n<p>In an effort to bring certainty to New York tenants, the New York State Senate passed the <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2019\/s8192\/amendment\/b\"><em>Tenants Safe Harbor Act (\u201cTSHA\u201d)<\/em><\/a> which superseded the previous executive orders passed by the Governor. The act <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2019\/s8192\/amendment\/b\"><em>prohibits non-payment evictions<\/em><\/a> of residential tenants who have suffered financial hardship as a result of COVID. Once the pandemic period ends, landlords will <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2019\/s8192\/amendment\/b\"><em>still not be able to evict<\/em><\/a> tenants for rent that accrued during the pandemic period. However, they will likely be able to get a money judgement against the tenant, which could have financial implications, such as <a href=\"https:\/\/www.nolo.com\/legal-encyclopedia\/new-york-income-execution-wage-garnishment-law.html#:~:text=Here%20are%20the%20rules%3A,cannot%20be%20garnished%20at%20all.\"><em>wage garnishment<\/em><\/a>. The act will help curb the tide of potential eviction orders filed because tenants will be able to use COVID-related financial hardship as a defense against an <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2019\/s8192\/amendment\/b\"><em>eviction brought because the tenant owes back rent<\/em><\/a>. This means that a judge would have <a href=\"https:\/\/utalbany.org\/wp-content\/uploads\/2020\/08\/8.2020_Safe-Harbor-Act-Explained-UTA.pdf\"><em>discretion to decide<\/em><\/a><em> <\/em>whether someone actually suffered \u201cfinancial hardship.\u201d This could lead to inconsistent decisions and uncertainty for tenants when eviction proceedings resume. <\/p>\n\n\n\n<p>In an attempt to bring some clarity and reassurance to tenants, Governor Cuomo expanded on the TSHA through <a href=\"https:\/\/www.governor.ny.gov\/news\/no-20266-continuing-temporary-suspension-and-modification-laws-relating-disaster-emergency\"><em>executive order<\/em><\/a>. The order modified the TSHA to <a href=\"https:\/\/www.governor.ny.gov\/news\/no-20266-continuing-temporary-suspension-and-modification-laws-relating-disaster-emergency\"><em>prevent evictions<\/em><\/a> for \u201cany residential tenant suffering financial hardship during the COVID-19 state disaster emergency declared by Executive Order 202.\u201d This language created more confusion, as the TSHA applied strictly to nonpayment evictions, while the executive order applies to <em>any <\/em>residential tenant experiencing financial hardship. The executive order seemed to expand the scope of protected tenants to all residential tenants who are experiencing COVID-related financial hardship regardless of whether the eviction stemmed from the nonpayment of rent. On October 9, 2020, the administrative court released an <a href=\"https:\/\/www.nycourts.gov\/whatsnew\/pdf\/AO-231-20.pdf\"><em>administrative order<\/em><\/a> which allows for eviction proceedings to resume subject to existing law. In its memorandum, the court acknowledged the <a href=\"https:\/\/therealdeal.com\/2020\/10\/09\/housing-court-new-york-evictions-can-resume-monday\/\"><em>inconsistency in the language<\/em><\/a> and stated that it would be resolved through judicial interpretation once cases resume. It is unclear which way the courts will come out on this issue, though tenants facing holdover evictions are undoubtedly in a precarious position and will not have the certainty of knowing that they are safe from eviction at that time. <\/p>\n\n\n\n<p>On December 28,\n2020, Governor Cuomo signed the <a href=\"https:\/\/www.governor.ny.gov\/news\/governor-cuomo-signs-covid-19-emergency-eviction-and-foreclosure-prevention-act-2020\"><em>COVID-19 Emergency Eviction and\nForeclosure Prevention Act of 2020<\/em><\/a> , strengthening the TSHA\nwhich extended the moratorium on residential evictions until May 1, 2020.\nTenants are required to submit a <a href=\"https:\/\/www.nysenate.gov\/newsroom\/articles\/2021\/covid-19-emergency-eviction-and-foreclosure-prevention-act-2020#:~:text=Declaration%20of%20Hardship%20(Renters)%20Read%20More&amp;text=Renters%20who%20have%20lost%20income,eviction%20until%20May%201%2C%202021.\"><em>hardship declaration<\/em><\/a> in\norder to prevent evictions for non-payment of rent. &nbsp;The act also contained a <a href=\"https:\/\/www.governor.ny.gov\/news\/governor-cuomo-signs-covid-19-emergency-eviction-and-foreclosure-prevention-act-2020\"><em>reprieve for homeowners and small\nlandlords<\/em><\/a> facing foreclosure who can file a hardship declaration\nwith their mortgage lender in order to prevent a foreclosure. As with the\nprotection for tenants, the protection for homeowners and small landlords is in\nplace until <a href=\"https:\/\/www.governor.ny.gov\/news\/governor-cuomo-signs-covid-19-emergency-eviction-and-foreclosure-prevention-act-2020\"><em>May 1, 2020<\/em><\/a>.<\/p>\n\n\n\n<p><strong>II. Federal Action<\/strong><\/p>\n\n\n\n<p><em>CDC Moratorium<\/em><\/p>\n\n\n\n<p>While New York took concrete measures to protect tenants during the pandemic, the same cannot be said of all states. While most states had a moratorium on evictions early in the pandemic, many <a href=\"https:\/\/www.newsweek.com\/eviction-moratoriums-update-each-state-1536436\"><em>governors allowed their orders to expire<\/em><\/a>, leaving tenants vulnerable to eviction at a time when the government has asked people to stay in their home to stop the spread of the virus. These inconsistent policies led to the federal government intervening and instituting the <a href=\"https:\/\/www.federalregister.gov\/documents\/2020\/09\/04\/2020-19654\/temporary-halt-in-residential-evictions-to-prevent-the-further-spread-of-covid-19\"><em>CDC moratorium<\/em><\/a>. Like the TSHA, the <a href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/downloads\/eviction-moratoria-order-faqs.pdf\"><em>CDC moratorium<\/em><\/a> only covers non-payment evictions. Therefore, in states without broader moratoriums, some evictions are still able to proceed. A key difference, however, is that the CDC moratorium only requires the tenant to fill out a <a href=\"https:\/\/templatelab.com\/declaration-form\/\" data-type=\"URL\" data-id=\"https:\/\/templatelab.com\/declaration-form\/\"><em>declaration<\/em> <\/a>that states that they have suffered financial hardships due to COVID. Once the tenant delivers the affidavit to their landlord, the landlord <a href=\"https:\/\/www.federalregister.gov\/documents\/2020\/09\/04\/2020-19654\/temporary-halt-in-residential-evictions-to-prevent-the-further-spread-of-covid-19\"><em>cannot bring eviction proceedings<\/em><\/a> against the tenant. However, the landlord can <a href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/downloads\/eviction-moratoria-order-faqs.pdf\"><em>challenge the truthfulness<\/em><\/a> of the declaration. The declaration advantageously does not require the tenant to appear in court to try and convince a judge that they are suffering financial hardships, unlike the requirement of the TSHA. <\/p>\n\n\n\n<p>One of the first\nacts the Biden administration enacted was <em>to <\/em><a href=\"https:\/\/time.com\/nextadvisor\/in-the-news\/biden-eviction-moratorium-extended-march-2021\/\"><em>extend the CDC moratorium<\/em><\/a>\nthrough March 2021. This is a welcome move for the estimated <a href=\"https:\/\/nlihc.org\/news\/30-40-million-people-america-could-be-evicted-their-homes-end-2020\"><em>thirty to forty million<\/em><\/a>\nrenters who were at risk of being evicted if the moratorium lapsed. It is now\nincumbent on the United States Congress to <a href=\"https:\/\/www.cnbc.com\/2021\/01\/14\/biden-calls-for-30-billion-in-rental-assistance-longer-eviction-ban-.html\"><em>further extend the moratorium and\nprovide rental assistance<\/em><\/a> in order protect vulnerable renters\nfacing eviction. <\/p>\n\n\n\n<p><strong>Conclusion<\/strong><\/p>\n\n\n\n<p>Both the CDC\nmoratorium and state moratoriums, though flawed, are a much-needed stop-gap to\nprotect tenants from being evicted during the pandemic. However, they do not\nstop the inevitable <a href=\"https:\/\/www.bostonherald.com\/2020\/10\/09\/housing-advocates-warn-of-a-potential-flood-of-eviction-filings-when-moratorium-expires\/\"><em>flood of evictions<\/em><\/a> that\nwill take place once the pandemic ceases. In response to this inevitability,\nseveral solutions have been proposed. For example, one of the most prominent is\nthe <a href=\"https:\/\/www.theatlantic.com\/ideas\/archive\/2020\/05\/cancel-rent\/611059\/\"><em>#CancelRent<\/em><\/a> movement, famously championed\nby Alexandria Ocasio-Cortez. While this is the most attractive solution for\ntenants, it has many <a href=\"https:\/\/www.nytimes.com\/2020\/05\/01\/nyregion\/rent-strike-coronavirus.html\"><em>landlords concerned<\/em><\/a>\nthat they will be left holding the bag and unable to keep up with their\nmortgages. <\/p>\n\n\n\n<p>A less-publicized\nbut more-feasible plan is rental subsidies provided by the <a href=\"https:\/\/www.marketplace.org\/2020\/10\/29\/__evictionban\/\"><em>federal government<\/em><\/a> to assist tenants who\ncurrently owe back rent. Tenants, who have lost their jobs because of COVID,\nhave found themselves in a financial hole with no relief in sight. Even once\nthey find a new job, they will still be saddled with the <a href=\"https:\/\/www.eastidahonews.com\/2020\/12\/i-have-4-to-my-name-an-extended-eviction-ban-isnt-enough-for-some-struggling-renters\/\"><em>back rent<\/em><\/a> they owe, and\nlandlords will be looking to resume eviction proceedings. A subsidy would allow\ntenants to <a href=\"https:\/\/wamu.org\/story\/20\/03\/17\/rent-freezes-emergency-subsidies-coronavirus-sparks-calls-to-protect-renters\/\"><em>catch up on back rent while also\nallowing landlords to receive compensation<\/em><\/a> so that they are able\nto pay expenses. Landlords will be incentivized to accept this subsidy instead\nof evicting tenants because it guarantees that landlords will receive some\nrevenue for the time of lost rent, and the landlord will still have the <a href=\"https:\/\/www.reuters.com\/article\/us-usa-housing-eviction-insight\/times-up-after-a-reprieve-a-wave-of-evictions-expected-across-u-s-idUSKBN27415U\"><em>option to evict the tenant<\/em><\/a>\nif they fall behind on rent after the pandemic has passed. <\/p>\n\n\n\n<p>At a time where the government is emphasizing the need for people to <a href=\"https:\/\/www.thecut.com\/article\/what-does-shelter-in-place-mean.html\"><em>stay at home<\/em><\/a>, the last thing state governments should allow is for their constituents to be kicked out onto the streets because they were unable to afford rent. The United States already faces a <a href=\"https:\/\/www.thenation.com\/article\/society\/how-america-chose-homelessness\/\"><em>homelessness crisis<\/em><\/a> and it is crucial that the pandemic does not exacerbate it. Additionally, it is clear that federal government leadership is needed to make sure this does not happen, but states, too, have a role to play. While the protections that New York put in place are not perfect, they are a model for states on how they can protect their citizens during these trying times.
