 {"id":3690,"date":"2021-04-30T16:40:14","date_gmt":"2021-04-30T16:40:14","guid":{"rendered":"https:\/\/live-journal-of-law-and-public-policy.pantheonsite.io\/?p=3690"},"modified":"2021-04-30T16:40:14","modified_gmt":"2021-04-30T16:40:14","slug":"making-mandatory-vaccines-in-the-workplace","status":"publish","type":"post","link":"https:\/\/publications.lawschool.cornell.edu\/jlpp\/2021\/04\/30\/making-mandatory-vaccines-in-the-workplace\/","title":{"rendered":"Making Mandatory: Vaccines in the Workplace"},"content":{"rendered":"\n<p style=\"text-align: center\"><span style=\"font-weight: 400\">(<\/span><a href=\"https:\/\/www.jhsph.edu\/covid-19\/articles\/a-top-vaccine-expert-answers-important-questions-about-a-covid-19-vaccine.html\"><i><span style=\"font-weight: 400\">Source<\/span><\/i><\/a><span style=\"font-weight: 400\">)<\/span><\/p>\n<p><span style=\"font-weight: 400\">According to the CDC\u2019s <\/span><a href=\"https:\/\/covid.cdc.gov\/covid-data-tracker\/#trends_dailytrendscases\"><i><span style=\"font-weight: 400\">COVID Data Tracker<\/span><\/i><\/a><span style=\"font-weight: 400\">, after hitting a peak in early January 2021 of over 300,000 new American coronavirus infections in a single day, the number of new cases began falling precipitously over the ensuing months, with the seven-day moving average dropping to 56,000 by late March. Not coincidentally, COVID vaccination efforts in the same time frame have been ramping up\u2014as of February 1, 2021, <\/span><a href=\"https:\/\/covid.cdc.gov\/covid-data-tracker\/#trends_dailytrendscases\"><i><span style=\"font-weight: 400\">32.2 million vaccines<\/span><\/i><\/a><span style=\"font-weight: 400\"> were administered in the U.S., with <a href=\"https:\/\/www.cnn.com\/2021\/01\/25\/politics\/biden-vaccine-distribution\/index.html\"><em>President<\/em><\/a><\/span><em><span style=\"font-weight: 400\"> Biden aiming<\/span><\/em><span style=\"font-weight: 400\"> to vaccinate 1.5 million more Americans each day. With over <\/span><a href=\"https:\/\/covid.cdc.gov\/covid-data-tracker\/#vaccinations\"><i><span style=\"font-weight: 400\">200 million doses<\/span><\/i><\/a><span style=\"font-weight: 400\"> in under two months, the Biden administration\u2019s original goal has been far exceeded, as 43% of Americans have already received at least one dose of the COVID vaccine as of the date of this writing. A consequence of the vaccination objective progressing at such an expeditious rate is that the overnight metamorphosis from in-person to remote work will likely begin to revert quickly as a <\/span><a href=\"https:\/\/www.propmodo.com\/five-companies-returning-to-the-office-and-five-that-arent\/\"><i><span style=\"font-weight: 400\">number of large corporations<\/span><\/i><\/a><span style=\"font-weight: 400\">, including Amazon, Apple, and Goldman Sachs, are expecting their workers to make a return to the office by midsummer.  <\/span><\/p>\n<p><span style=\"font-weight: 400\">While Facebook CEO, Mark Zuckerberg, has <\/span><a href=\"https:\/\/www.nytimes.com\/2020\/05\/21\/technology\/facebook-remote-work-coronavirus.html\"><i><span style=\"font-weight: 400\">envisioned<\/span><\/i><\/a><span style=\"font-weight: 400\"> that half of the 48,000 employees at his company could be moving to permanent remote work within the next decade, the reality for many is that a return to the office is inevitable\u2014the question is simply when and under what conditions. A <\/span><a href=\"https:\/\/www.gensler.com\/research-insight\/blog\/most-people-want-to-return-to-the-office-but-expect-changes\"><i><span style=\"font-weight: 400\">study<\/span><\/i><\/a><span style=\"font-weight: 400\"> of over 2,300 American workers across ten industries found that while 12% of those currently working from home would like to continue doing so full-time, even after the pandemic, the vast majority actually desire a return to the physical workplace. However, because the coronavirus\u2019s <\/span><a href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/prevent-getting-sick\/how-covid-spreads.html\"><i><span style=\"font-weight: 400\">main source of transmission<\/span><\/i><\/a><span style=\"font-weight: 400\"> is in-person interactions, employers looking to facilitate the safe return of their employees back into the workplace face a precarious predicament.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Although the onset of COVID-19 has certainly produced a new set of exigent issues, the obstacles associated with creating a safe workplace amidst a global pandemic are not novel. It is estimated that in the first year of the 2009 H1N1 pandemic\u2014more commonly known as the swine flu pandemic\u2014up to <\/span><a href=\"https:\/\/www.cdc.gov\/flu\/pandemic-resources\/2009-h1n1-pandemic.html\"><i><span style=\"font-weight: 400\">575,400 individuals worldwide<\/span><\/i><\/a><span style=\"font-weight: 400\"> died from the novel influenza virus. Resembling the coronavirus, the <\/span><a href=\"https:\/\/www.who.int\/emergencies\/diseases\/novel-coronavirus-2019\/question-and-answers-hub\/q-a-detail\/coronavirus-disease-covid-19-similarities-and-differences-with-influenza\"><i><span style=\"font-weight: 400\">influenza virus spreads<\/span><\/i><\/a><span style=\"font-weight: 400\"> primarily through respiratory droplets traveling from any symptomatic or asymptomatic infected individual to those nearby, presenting a similar set of public health challenges to those currently posed by COVID-19. In an effort to combat the transmission of swine flu in the workplace, hospitals across the nation, including the <\/span><a href=\"https:\/\/whyy.org\/articles\/flu-vaccine-is-mandatory-for-chop-penn-medicine-workers\/\"><i><span style=\"font-weight: 400\">University of Pennsylvania Health System<\/span><\/i><\/a> <span style=\"font-weight: 400\">and <\/span><a href=\"https:\/\/www.ajc.com\/news\/local\/emory-grady-make-seasonal-flu-shots-mandatory\/eoEjMweYVRGn5d07eKmdSJ\/\"><i><span style=\"font-weight: 400\">Emory Healthcare<\/span><\/i><\/a><span style=\"font-weight: 400\"> (both among the largest hospitals in their respective state), began conditioning continued employment on their employees receiving a flu vaccination. Because doctors, nurses, and other hospital staff are in constant and direct contact with patients\u2014many of whom are especially vulnerable to the injurious effects of disease\u2014these hospitals <\/span><a href=\"https:\/\/www.nbcnews.com\/health\/health-news\/they-didn-t-get-vaccinated-now-they-re-out-jobs-n823446\"><i><span style=\"font-weight: 400\">felt that it was imperative<\/span><\/i><\/a><span style=\"font-weight: 400\"> for their employees to be properly immunized against lethal viruses as a matter of public and patient safety.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Vaccines aid our bodies in developing an immunity to disease, but society requires a high enough percentage of vaccinated individuals \u201c<\/span><a href=\"https:\/\/www.npr.org\/sections\/health-shots\/2021\/02\/03\/963373971\/a-rocky-road-on-the-way-to-herd-immunity-for-covid-19\"><i><span style=\"font-weight: 400\">before the disease will wane through a process known as herd immunity<\/span><\/i><\/a><span style=\"font-weight: 400\">.\u201d With COVID-19, scientists <\/span><a href=\"https:\/\/www.npr.org\/sections\/health-shots\/2021\/02\/03\/963373971\/a-rocky-road-on-the-way-to-herd-immunity-for-covid-19\"><i><span style=\"font-weight: 400\">figure<\/span><\/i><\/a> <span style=\"font-weight: 400\">that at least 70% of the American population will need to receive a vaccine before herd immunity is achieved, and utilizing a workplace vaccine mandate can help speed this process up considerably. The <\/span><a href=\"https:\/\/www.fisherphillips.com\/news-insights\/combating-the-flu-retail-sector-employers-among-most-prone-to-workplace-disruptions.html\"><i><span style=\"font-weight: 400\">CDC has estimated<\/span><\/i><\/a><span style=\"font-weight: 400\"> that without a workplace vaccine mandate in place, only 43% of workers typically get vaccinated, but the figure jumps to 85% once such a policy is implemented. In practice, <\/span><a href=\"https:\/\/www.nbcnews.com\/health\/health-news\/they-didn-t-get-vaccinated-now-they-re-out-jobs-n823446\"><i><span style=\"font-weight: 400\">compliance<\/span><\/i><\/a><span style=\"font-weight: 400\"> with compulsory workplace vaccines has been found to reach as high as nearly 100%. In fact, in 2017, after a large <\/span><a href=\"https:\/\/www.nbcnews.com\/health\/health-news\/they-didn-t-get-vaccinated-now-they-re-out-jobs-n823446\"><i><span style=\"font-weight: 400\">Midwest healthcare provider instituted<\/span><\/i><\/a><span style=\"font-weight: 400\"> a strict employee flu vaccination requirement, out of nearly 14,000 employees, only fifty were dismissed for non-compliance. While most employees would undoubtedly prefer the carrot\u2014such as <\/span><a href=\"https:\/\/www.orlandoweekly.com\/Blogs\/archives\/2021\/04\/28\/walt-disney-world-offering-bonuses-to-employees-who-get-vaccinated\"><i><span style=\"font-weight: 400\">one-time bonus payments<\/span><\/i><\/a><span style=\"font-weight: 400\"> being given by employers for receiving the COVID vaccine\u2014to the stick, the simple truth is that it may not be possible, as one infectious disease expert has <\/span><a href=\"https:\/\/www.nbcnews.com\/health\/health-news\/they-didn-t-get-vaccinated-now-they-re-out-jobs-n823446\"><i><span style=\"font-weight: 400\">claimed<\/span><\/i><\/a><span style=\"font-weight: 400\">, to \u201cget to a high immunization rate without some kind of mandatory flu vaccination program.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">It should be noted that although both the Equal Employment Opportunity Commission and Occupational Safety and Health Administration have deemed employer mandated flu vaccination policies <\/span><a href=\"https:\/\/www.vonbriesen.com\/legal-news\/5900\/mandatory-covid-19-vaccination-in-employment\"><i><span style=\"font-weight: 400\">permissible<\/span><\/i><\/a><span style=\"font-weight: 400\">, these provisions have typically only been found within the healthcare industry. Nevertheless, with both the<\/span> <a href=\"https:\/\/www.who.int\/emergencies\/diseases\/novel-coronavirus-2019\/question-and-answers-hub\/q-a-detail\/coronavirus-disease-covid-19-similarities-and-differences-with-influenza\"><i><span style=\"font-weight: 400\">transmission and mortality rates<\/span><\/i><\/a><span style=\"font-weight: 400\"> of the coronavirus<\/span> <span style=\"font-weight: 400\">being much higher than that of the influenza virus, employee COVID vaccination requirements have begun to venture beyond the walls of hospitals and healthcare clinics. Indeed, COVID vaccines have <\/span><a href=\"https:\/\/www.wsj.com\/articles\/want-that-job-offer-a-covid-19-vaccine-is-now-required-11619438580\"><i><span style=\"font-weight: 400\">recently been added<\/span><\/i><\/a><span style=\"font-weight: 400\"> to the list of prerequisites applicants must fulfill in order to work in a number of industries across the country. <\/span><a href=\"https:\/\/www.wsj.com\/articles\/want-that-job-offer-a-covid-19-vaccine-is-now-required-11619438580\"><i><span style=\"font-weight: 400\">From<\/span><\/i><\/a><span style=\"font-weight: 400\"> the sommelier and ma\u00eetre d\u2019 positions at New York\u2019s iconic fine dining restaurant, Eleven Madison Park, to accounting and managerial roles with JBS USA Holdings Inc., one of the country\u2019s largest food processing companies, employers have begun utilizing compulsory vaccines to create a safer workplace environment for both their employees and customers. These policies, however, have not been implemented without opposition. <\/span><\/p>\n<p><span style=\"font-weight: 400\">The partisan divide on vaccination is clear; a <\/span><a href=\"https:\/\/www.cnbc.com\/2020\/12\/18\/require-covid-19-vaccine-for-work-return-heres-what-americans-say.html\"><i><span style=\"font-weight: 400\">survey<\/span><\/i><\/a><span style=\"font-weight: 400\"> found that while 75% of Democrats support a mandate requiring a COVID vaccination at their workplace, 41% of Republicans are strongly opposed to such a requirement. In fact, bills\u2014many of which are Republican sponsored\u2014outlawing the ability of employers to condition employment on vaccination <\/span><a href=\"https:\/\/www.pewtrusts.org\/en\/research-and-analysis\/blogs\/stateline\/2021\/02\/23\/bills-to-block-mandatory-worker-vaccines-falter-in-the-states\"><i><span style=\"font-weight: 400\">have been proposed<\/span><\/i><\/a><span style=\"font-weight: 400\"> in at least 23 states. Arguments centered primarily around <\/span><a href=\"https:\/\/www.nytimes.com\/2021\/02\/26\/opinion\/business-economics\/company-vaccine-requirements.html\"><i><span style=\"font-weight: 400\">personal autonomy<\/span><\/i><\/a><span style=\"font-weight: 400\"> as well as the <\/span><a href=\"https:\/\/abcnews.go.com\/Health\/SwineFluNews\/mandatory-flu-vaccines-upset-nurses\/story?id=8727353\"><i><span style=\"font-weight: 400\">safety and effectiveness<\/span><\/i><\/a><span style=\"font-weight: 400\"> of the vaccine itself have emerged from critics of potential workplace vaccination policies. The California Nurses Association and the National Nurses Organizing Committee have strongly <\/span><a href=\"https:\/\/abcnews.go.com\/Health\/SwineFluNews\/mandatory-flu-vaccines-upset-nurses\/story?id=8727353\"><i><span style=\"font-weight: 400\">encouraged<\/span><\/i><\/a><span style=\"font-weight: 400\"> nurses to receive flu vaccinations in the past but have maintained that the decision should ultimately be left up to the nurses themselves. Citing concerns about the shortened safety trial period, other <\/span><a href=\"https:\/\/abcnews.go.com\/Health\/SwineFluNews\/mandatory-flu-vaccines-upset-nurses\/story?id=8727353\"><i><span style=\"font-weight: 400\">opponents have had issues<\/span><\/i><\/a><span style=\"font-weight: 400\"> with the potential side effects and safety of vaccines\u2014such as the H1N1 and COVID-19 vaccines\u2014that have been accelerated through clinical trials in order to fight global pandemics. Nevertheless, numerous public health agencies and <\/span><a href=\"https:\/\/www.hopkinsmedicine.org\/health\/conditions-and-diseases\/coronavirus\/is-the-covid19-vaccine-safe\"><i><span style=\"font-weight: 400\">experts have attested<\/span><\/i><\/a><span style=\"font-weight: 400\"> to the safety of the vaccines currently being administered nationwide. <\/span><\/p>\n<p><span style=\"font-weight: 400\">Ultimately, a company contemplating a compulsory COVID vaccination policy must weigh the importance of potentially violating their employees\u2019 individual freedoms with the need for both public and workplace safety. For a country that has traditionally championed personal liberties, policies like this may be a hard pill to swallow; however, as the adage goes, \u201cWith great sacrifice comes great reward.\u201d In this context, the reward may be a swifter return to a society that resembles pre-pandemic life. <\/span><\/p>\n<p> <\/p>\n\n\n\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:100%\">\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-media-text alignwide is-stacked-on-mobile\" style=\"grid-template-columns:44% auto\"><figure class=\"wp-block-media-text__media\"><img loading=\"lazy\" decoding=\"async\" width=\"262\" height=\"285\" src=\"https:\/\/live-journal-of-law-and-public-policy.pantheonsite.io\/wp-content\/uploads\/2021\/04\/Picture11.png\" alt=\"\" class=\"wp-image-3691 size-full\" \/><\/figure><div class=\"wp-block-media-text__content\">\n<p class=\"has-text-align-left has-normal-font-size\"><strong>About the Author: <\/strong>Austin Peng is a J.D. candidate in the class of 2022 at Cornell Law School.
