 {"id":3776,"date":"2021-10-28T21:41:30","date_gmt":"2021-10-28T21:41:30","guid":{"rendered":"https:\/\/live-journal-of-law-and-public-policy.pantheonsite.io\/?p=3776"},"modified":"2021-10-28T21:41:30","modified_gmt":"2021-10-28T21:41:30","slug":"the-parent-trap-addressing-the-legal-anomaly-blocking-the-annulment-of-same-sex-adult-adoptions","status":"publish","type":"post","link":"https:\/\/publications.lawschool.cornell.edu\/jlpp\/2021\/10\/28\/the-parent-trap-addressing-the-legal-anomaly-blocking-the-annulment-of-same-sex-adult-adoptions\/","title":{"rendered":"The Parent Trap: Addressing the Legal Anomaly Blocking the Annulment of Same-Sex Adult Adoptions"},"content":{"rendered":"\n<p style=\"text-align: center\"><a href=\"https:\/\/www.pewresearch.org\/fact-tank\/2019\/06\/24\/same-sex-marriage\/\"><span style=\"font-weight: 400\">(<em>Source<\/em>)<\/span><\/a><\/p>\n<p><span style=\"font-weight: 400\">The Supreme Court&#8217;s fateful decision in <\/span><a href=\"https:\/\/www.supremecourt.gov\/opinions\/14pdf\/14-556_3204.pdf\"><i><span style=\"font-weight: 400\">Obergefell v. Hodges<\/span><\/i><\/a> <span style=\"font-weight: 400\">will forever be an incredible achievement for the LGBTQ+ community. The <\/span><a href=\"https:\/\/nhm.org\/stories\/anniversary-obergefell-v-hodges\"><i><span style=\"font-weight: 400\">landmark case<\/span><\/i><\/a> <span style=\"font-weight: 400\">declaring same-sex marriage legal across all 50 states celebrated its sixth anniversary this past June. Even still, with <\/span><a href=\"https:\/\/www.americanprogress.org\/issues\/lgbtq-rights\/reports\/2020\/10\/06\/491052\/state-lgbtq-community-2020\/\"><i><span style=\"font-weight: 400\">rampant discrimination<\/span><\/i><\/a><span style=\"font-weight: 400\">, <\/span><a href=\"https:\/\/williamsinstitute.law.ucla.edu\/publications\/lgbt-homelessness-us\/\"><i><span style=\"font-weight: 400\">elevated homeless rates<\/span><\/i><\/a><span style=\"font-weight: 400\">, and <\/span><a href=\"https:\/\/www.hrc.org\/resources\/sexual-assault-and-the-lgbt-community\"><i><span style=\"font-weight: 400\">higher chances for sexual assault<\/span><\/i><\/a><span style=\"font-weight: 400\">,<\/span><span style=\"font-weight: 400\"> the LGBTQ+ community has a tumultuous road ahead to achieve full equality. Simply granting the right to marry is not enough; as it stands<\/span><i><span style=\"font-weight: 400\">, <\/span><\/i><a href=\"https:\/\/slate.com\/human-interest\/2015\/11\/adult-adoption-for-gay-couples-can-the-adoptions-be-undone-for-marriage.html\"><i><span style=\"font-weight: 400\">some gay couples are unable to access their constitutional right at all<\/span><\/i><\/a><span style=\"font-weight: 400\">. This frustrating barrier finds its roots in a lack of legislation addressing the pre-<\/span><i><span style=\"font-weight: 400\">Obergefell <\/span><\/i><span style=\"font-weight: 400\">practice of <\/span><a href=\"https:\/\/digitalcommons.law.ggu.edu\/cgi\/viewcontent.cgi?article=1337&amp;context=ggulrev\"><i><span style=\"font-weight: 400\">adult adoption between gay partners<\/span><\/i><\/a><span style=\"font-weight: 400\">.  <\/span><\/p>\n<p><span style=\"font-weight: 400\">Before the <\/span><a href=\"https:\/\/www.nytimes.com\/2021\/05\/30\/books\/review\/the-engagement-sasha-issenberg.html\"><i><span style=\"font-weight: 400\">gay rights movement<\/span><\/i><\/a> <span style=\"font-weight: 400\">spearheaded successes like the <\/span><i><span style=\"font-weight: 400\">Obergefell <\/span><\/i><span style=\"font-weight: 400\">decision, LGBTQ+ couples <\/span><a href=\"http:\/\/www.floridalawreview.com\/wp-content\/uploads\/6-Keefe.pdf\"><i><span style=\"font-weight: 400\">had few means of acquiring legal status as a family<\/span><\/i><\/a><span style=\"font-weight: 400\">. With limited options at hand, gay couples in the 1980s began to use adult adoption, in which one partner legally adopted the other, to ensure their partner\u2019s <\/span><a href=\"https:\/\/www.nytimes.com\/2015\/10\/19\/magazine\/the-lost-history-of-gay-adult-adoption.html\"><i><span style=\"font-weight: 400\">inheritance, property, and hospital visitation rights<\/span><\/i><\/a><span style=\"font-weight: 400\">. Unlike domestic partnerships, adult adoption allowed gay couples to achieve a \u201cpseudo marriage\u201d status, even if this meant that legally the couple would be considered parent and child. This was a <\/span><a href=\"https:\/\/surface.syr.edu\/cgi\/viewcontent.cgi?article=1081&amp;context=lawpub\"><i><span style=\"font-weight: 400\">common practice nationwide<\/span><\/i><\/a><span style=\"font-weight: 400\">, especially with <\/span><a href=\"https:\/\/www.advocate.com\/current-issue\/2016\/1\/08\/why-some-couples-must-undo-adoptions-marry\"><i><span style=\"font-weight: 400\">little expectation that gay marriage would ever become a constitutional right<\/span><\/i><\/a><i><span style=\"font-weight: 400\">.<\/span><\/i><span style=\"font-weight: 400\"> Even so, it was not a practice fully welcomed. One New York court notably denied an adoption between a man and his gay lover in <\/span><a href=\"https:\/\/casetext.com\/case\/matter-of-robert-paul-p\"><i><span style=\"font-weight: 400\">Matter of Adoption of Robert Paul P.<\/span><\/i><\/a><span style=\"font-weight: 400\">. Here, the court refused to set a precedent for adult adoption as a <\/span><a href=\"https:\/\/casetext.com\/case\/matter-of-robert-paul-p\"><i><span style=\"font-weight: 400\">\u201cquasi-matrimonial vehicle to provide nonmarried partners with a legal imprimatur for their sexual relationship, be it heterosexual or homosexual.\u201d<\/span><\/i><\/a> <span style=\"font-weight: 400\">This was an outlier, however, as <\/span><a href=\"https:\/\/verdict.justia.com\/2011\/10\/20\/the-potential-consequences-of-adult-adoption-for-inheritance\"><i><span style=\"font-weight: 400\">many other states<\/span><\/i><\/a><span style=\"font-weight: 400\"> instead approved adult adoptions between same-sex couples, as in the Delaware case of <\/span><a href=\"https:\/\/casetext.com\/case\/in-re-adoption-of-swanson\"><i><span style=\"font-weight: 400\">In re Adoption of Swanson<\/span><\/i><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Now that same-sex marriage is a constitutional right, the next step for gay couples who chose adult adoption as an alternative to marriage appeared deceptively straightforward: annul the adoption and get married instead. However, adoption is a primarily<\/span> <a href=\"https:\/\/www.childwelfare.gov\/topics\/adoption\/laws\/\"><i><span style=\"font-weight: 400\">State-regulated<\/span><\/i><\/a> <span style=\"font-weight: 400\">practice, with variation from state to state. With no uniform legislation in place, <\/span><a href=\"http:\/\/www.floridalawreview.com\/wp-content\/uploads\/6-Keefe.pdf\"><i><span style=\"font-weight: 400\">gay couples wishing to annul their adoptions are effectively at the mercy of state judges<\/span><\/i><\/a><span style=\"font-weight: 400\">, who have no obligation to grant the annulment requests. Furthermore, <\/span><a href=\"https:\/\/scholarship.law.nd.edu\/cgi\/viewcontent.cgi?referer=&amp;httpsredir=1&amp;article=3662&amp;context=ndlr\"><i><span style=\"font-weight: 400\">adoptions can already be difficult to annul without the added complexity of a desire to marry<\/span><\/i><\/a><span style=\"font-weight: 400\">. Generally speaking, courts <\/span><span style=\"font-weight: 400\">are <\/span><a href=\"https:\/\/scholarlycommons.law.wlu.edu\/cgi\/viewcontent.cgi?article=4651&amp;context=wlulr\"><i><span style=\"font-weight: 400\">reluctant to overturn adoptions<\/span><\/i><\/a> <span style=\"font-weight: 400\">unless there was fraud, deceit, or undue influence present. <\/span><\/p>\n<p><span style=\"font-weight: 400\">The question remained: what if the couples were to marry regardless of the legal barrier in place? After all, the couples were not truly related and did not desire a filial relationship. Unfortunately, same-sex couples who try to marry while the adoption remains in place still run the risk of violating <\/span><a href=\"https:\/\/www.nytimes.com\/2015\/10\/19\/magazine\/the-lost-history-of-gay-adult-adoption.html\"><i><span style=\"font-weight: 400\">state incest laws<\/span><\/i><\/a><span style=\"font-weight: 400\">,<\/span> <span style=\"font-weight: 400\">effectively trapping them in the role of parent with no standard means of release. As it stands, there are 25 states that regard <\/span><a href=\"https:\/\/www.advocate.com\/current-issue\/2016\/1\/08\/why-some-couples-must-undo-adoptions-marry\"><i><span style=\"font-weight: 400\">\u201crelationships between adoptive parents and their adult children within the definition of incest\u201d<\/span><\/i><\/a><span style=\"font-weight: 400\">. As previously mentioned, <\/span><a href=\"http:\/\/www.floridalawreview.com\/wp-content\/uploads\/6-Keefe.pdf\"><i><span style=\"font-weight: 400\">all hope would lie in the hands of the judge overlooking the annulment request<\/span><\/i><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Nino Esposito and Roland Bosee were <\/span><a href=\"https:\/\/time.com\/4099253\/same-sex-gay-couple-adoption-marriage\/\"><i><span style=\"font-weight: 400\">one such couple<\/span><\/i> <\/a><span style=\"font-weight: 400\">that had their annulment application denied, only for it to be <\/span><a href=\"https:\/\/epgn.com\/2016\/12\/22\/court-clears-way-for-pa-man-s-same-sex-marriage\/\"><i><span style=\"font-weight: 400\">granted on appeal<\/span><\/i><\/a><span style=\"font-weight: 400\"> to Pennsylvania Superior Court. The two were together for decades before deciding to go through with the adoption in 2012, as adoption was the <\/span><a href=\"https:\/\/time.com\/4099253\/same-sex-gay-couple-adoption-marriage\/\"><i><span style=\"font-weight: 400\">\u201cmost legitimate thing available\u201d<\/span><\/i><\/a> <span style=\"font-weight: 400\">for them at the time. Same-sex marriage became legal in Pennsylvania only <\/span><a href=\"http:\/\/www.freedomtomarry.org\/states\/pennsylvania\"><i><span style=\"font-weight: 400\">two years later<\/span><\/i><\/a><span style=\"font-weight: 400\">. Hoping to enjoy this new freedom, the couple requested an annulment. Although the local court judge expressed his sympathies, he ultimately <\/span><a href=\"https:\/\/fox59.com\/news\/same-sex-couple-seeks-right-to-marry-the-hitch-theyre-father-and-son\/\"><i><span style=\"font-weight: 400\">cited Pennsylvania state law<\/span><\/i><\/a> <span style=\"font-weight: 400\">that required the presence of fraud in his rejection of their request. While Esposito and Bosee were eventually able to<\/span> <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-4056452\/Court-says-gay-couple-revoke-adoption-order-marry.html\"><i><span style=\"font-weight: 400\">succeed on appeal<\/span><\/i><\/a><span style=\"font-weight: 400\">, not all couples can be so lucky.  <\/span><\/p>\n<p><span style=\"font-weight: 400\">The case-by-case basis of addressing these issues highlights the unfortunate truth that regardless of how society progresses, the law will always straggle behind rather than keep up. Indeed there are still <\/span><a href=\"https:\/\/www.abc27.com\/news\/pennsylvania\/same-sex-marriage-is-legal-in-pennsylvania-but-some-of-its-laws-are-stuck-in-the-past\/\"><i><span style=\"font-weight: 400\">contradictory laws<\/span><\/i><\/a> <span style=\"font-weight: 400\">in Pennsylvania that define marriage as between a man and a woman, despite the six years that have passed since same-sex marriage became legal nationwide. There needs to be state legislation put into place to free same-sex couples from the trap of legal parenthood, without having to rely on the good will of individual judges to do so. The nature of these adult adoptions is discrete and unique to the circumstances of the LGBTQ+ community pre-<\/span><i><span style=\"font-weight: 400\">Obergefell. <\/span><\/i><\/p>\n<p><span style=\"font-weight: 400\">While not necessarily formed through fraud or undue influence, these same-sex couples felt they had <\/span><a href=\"https:\/\/www.nytimes.com\/2015\/10\/19\/magazine\/the-lost-history-of-gay-adult-adoption.html\"><i><span style=\"font-weight: 400\">no other option to achieve the property and inheritance rights granted to their heterosexual counterparts<\/span><\/i><\/a><span style=\"font-weight: 400\">. The solution here would be rather simple: allow for the dissolution of adult adoptions between same-sex couples if the main motivation behind the adoption was to achieve \u201cpseudo marriage\u201d status and the adoption took place pre-<\/span><i><span style=\"font-weight: 400\">Obergefell<\/span><\/i><span style=\"font-weight: 400\">. There has been little discussion of this legal anomaly among courts and legislatures alike. Given that adoption is <\/span><a href=\"https:\/\/www.childwelfare.gov\/topics\/adoption\/laws\/\"><i><span style=\"font-weight: 400\">State-regulated<\/span><\/i><\/a><span style=\"font-weight: 400\">, this is something that state legislators must actively address as federal action from the Justice Department would have <\/span><a href=\"https:\/\/www.post-gazette.com\/news\/state\/2015\/11\/02\/Senator-Casey-seeks-Justice-Dept-guidance-on-adult-adoptions-by-gay-couples\/stories\/201511010187\"><i><span style=\"font-weight: 400\">no binding effect<\/span><\/i><\/a><span style=\"font-weight: 400\"> on the courts. One possible solution is to pass state mandates binding the courts to permit LGBTQ+ couples who previously entered adoptions to annul them to receive marriage licenses. States already took similar action post<\/span><i><span style=\"font-weight: 400\">-Obergefell<\/span><\/i><span style=\"font-weight: 400\"> where <\/span><a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=2914611\"><i><span style=\"font-weight: 400\">gay couples that entered into domestic partnerships or civil unions before the legalization of gay marriage were allowed to transition into a married status<\/span><\/i><\/a><span style=\"font-weight: 400\">. <\/span><span style=\"font-weight: 400\">Legalizing same-sex marriage was just touching upon the tip of the equality iceberg- the path to true equality does not and cannot end here. <\/span><\/p>\n\n\n\n<div class=\"wp-block-media-text alignwide is-stacked-on-mobile\"><figure class=\"wp-block-media-text__media\"><img loading=\"lazy\" decoding=\"async\" width=\"233\" height=\"309\" src=\"https:\/\/live-journal-of-law-and-public-policy.pantheonsite.io\/wp-content\/uploads\/2021\/10\/nicolebissuespotter.jpg\" alt=\"\" class=\"wp-image-3779 size-full\" srcset=\"https:\/\/publications.lawschool.cornell.edu\/jlpp\/wp-content\/uploads\/sites\/3\/2021\/10\/nicolebissuespotter.jpg 233w, https:\/\/publications.lawschool.cornell.edu\/jlpp\/wp-content\/uploads\/sites\/3\/2021\/10\/nicolebissuespotter-226x300.jpg 226w\" sizes=\"auto, (max-width: 233px) 100vw, 233px\" \/><\/figure><div class=\"wp-block-media-text__content\">\n<p><strong>About the Author:<\/strong> Nicole Belenitsky is a second-year student at Cornell Law School.
