Overlapping with the <a href=\"https:\/\/www.nytimes.com\/2016\/10\/27\/nyregion\/new-york-commute-dusk-and-darkness-safety-campaign.html\"><em>evening commute<\/em><\/a>, diminished daylight comprises visibility and increases the danger for drivers and pedestrians alike. Impacting accident trends is not unique to standard time. <a href=\"https:\/\/www.bbc.com\/future\/article\/20251024-how-daylight-saving-time-affects-our-health\"><em>During daylight savings<\/em><\/a>, accidents increase in the early hours\u2014as workers embark on caffeine-fueled commute to the office and children head to school.<\/p>\n\n\n\n<p>Year-round, drivers face heightened risks when the sun is out of sight. In fact, independent of whether clocks are set to standard time, \u201c<a href=\"https:\/\/highways.dot.gov\/safety\/other\/visibility\/nighttime-visibility-overview#:~:text=About%20half%20of%20traffic%20fatalities,challenging%20due%20to%20decreased%20visibility.\"><em>about half of traffic fatalities occur at night<\/em><\/a>\u201d despite nighttime driving constituting only one quarter of overall travel. The impact of poor lighting conditions on driving ability enlightens the seemingly sudden LED headlight infiltration over the past two decades. Installed in <a href=\"https:\/\/www.wsj.com\/lifestyle\/car-led-headlights-too-bright-safety-driving-df0dd05e?gaa_at=eafs&amp;gaa_n=AWEtsqdd7wBGkluVYEqUEWvRV9u1sTZuIbcos1glaRK7UpLFaD0O28s6ozcefeWXhUQ%3D&amp;gaa_ts=690e70ca&amp;gaa_sig=f0D_VQ7hECx_8MRZG7uCIx-fglgGjxeIbKhrYKSwyxiHHLi_mFu7a_kp5pFm-p0gFMJ_qd7BXKBIUR8KBeih7Q%3D%3D\"><em>76%<\/em><\/a> of new U.S. cars in 2023, LED bulbs have largely replaced their predecessor: the halogen bulb. While halogen bulbs produce <a href=\"https:\/\/www.freep.com\/story\/news\/local\/michigan\/2025\/02\/05\/led-headlights-blind-drivers-glare-michigan\/78213162007\/\"><em>900 to 1,000 lumens<\/em><\/a> of light, LED bulbs produce from <a href=\"https:\/\/www.freep.com\/story\/news\/local\/michigan\/2025\/02\/05\/led-headlights-blind-drivers-glare-michigan\/78213162007\/\"><em>3,600 to 4,500 lumens<\/em><\/a> of light. About 60% brighter than halogens, LED bulbs \u201coffer <a href=\"https:\/\/www.wsj.com\/lifestyle\/car-led-headlights-too-bright-safety-driving-df0dd05e?gaa_at=eafs&amp;gaa_n=AWEtsqdd7wBGkluVYEqUEWvRV9u1sTZuIbcos1glaRK7UpLFaD0O28s6ozcefeWXhUQ%3D&amp;gaa_ts=690e70ca&amp;gaa_sig=f0D_VQ7hECx_8MRZG7uCIx-fglgGjxeIbKhrYKSwyxiHHLi_mFu7a_kp5pFm-p0gFMJ_qd7BXKBIUR8KBeih7Q%3D%3D\"><em>better road illumination<\/em><\/a>,\u201d emitting \u201cmore light, and a <a href=\"https:\/\/www.washingtontimes.com\/news\/2025\/may\/23\/blinded-light-house-lawmaker-wants-congress-cut-led-glare-car\/\"><em>brighter bluish light<\/em><\/a> than halogen bulbs.\u201d Even more, <a href=\"https:\/\/www.washingtontimes.com\/news\/2025\/may\/23\/blinded-light-house-lawmaker-wants-congress-cut-led-glare-car\/\"><em>automakers favor<\/em><\/a> LED bulbs as \u201cthey are less expensive and considered more reliable, have a longer lifespan and use less energy.\u201d<\/p>\n\n\n\n<p>While LED headlights are indeed brighter, whether this difference ultimately equates to enhanced road safety is up for debate. As it appears, many drivers do not think so. <a href=\"https:\/\/www.freep.com\/story\/news\/local\/michigan\/2025\/02\/05\/led-headlights-blind-drivers-glare-michigan\/78213162007\/?gnt-cfr=1&amp;gca-cat=p&amp;gca-uir=true&amp;gca-epti=z113131p001228c001228d00----v113131b0044xxd004465&amp;gca-ft=178&amp;gca-ds=sophi\"><em>As early as 2004<\/em><\/a>, \u201cabout 30% of drivers experienced a \u2018disturbing\u2019 nighttime glare while driving.\u201d More recently, <a href=\"https:\/\/www.gbnews.com\/lifestyle\/cars\/driving-law-changes-vision-impairment-led-headlights\"><em>new data<\/em><\/a> shows LED headlights in particular concern drivers, with \u201calmost three in five motorists (57 percent) believ[ing] LED headlights are too bright.\u201d<\/p>\n\n\n\n<p>These concerns are not unfounded, as the increased brightness also <a href=\"https:\/\/www.freep.com\/story\/news\/local\/michigan\/2025\/02\/05\/led-headlights-blind-drivers-glare-michigan\/78213162007\/\"><em>produces more glare<\/em><\/a>. According to the National Highway Traffic Administration (NHTSA), the increased glare of brighter headlights reduces other drivers\u2019 visibility and creates <a href=\"https:\/\/www.nhtsa.gov\/sites\/nhtsa.gov\/files\/glare_congressional_report.pdf\"><em>feelings of discomfort<\/em><\/a>\u2014such as \u201cthe feeling of annoyance or even pain . . . [and] can distract drivers from the driving task, cause them to slow down, and cause drift slightly in their lane.\u201d<\/p>\n\n\n\n<p>Moreover, drivers with vision impairments experience even graver threat when facing an onslaught of dazzling light on a dark road. Astigmatism, for example, is the <a href=\"https:\/\/doi.org\/10.1016\/j.joco.2017.08.009\"><em>most common refractive error<\/em><\/a>\u2014with a 2018 study estimating astigmatism affects 40% of adults. Experiencing <a href=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC10045990\/\"><em>decreased vision quality<\/em><\/a> and increased glare, in the age of unchecked LED headlights, nighttime driving for astigmatic individuals can often feel like closing your eyes and hoping for the best would be safer.<\/p>\n\n\n\n<p>Likewise, NHTSA studies show the natural decay of cells leaves drivers over fifty seeing a greater \u201c<a href=\"https:\/\/www.nhtsa.gov\/sites\/nhtsa.gov\/files\/811043.pdf\"><em>amount of scattered light<\/em><\/a> compared to younger drivers, resulting in a brighter \u2018veil\u2019 over the scene\u201d when facing glare. Factoring in increased driver discomfort, the NHTSA noted a potential connection to \u201cpoorer steering control, lane-keeping, and speed control.\u201d<\/p>\n\n\n\n<p>Beyond the inherent glare-creating capabilities of LED headlights, a variety of other factors exacerbate the visual interference. Firstly,&nbsp; \u201cthe rise in popularity of <a href=\"https:\/\/www.gbnews.com\/lifestyle\/cars\/driving-law-changes-vision-impairment-led-headlights\"><em>SUVs and other larger vehicles<\/em><\/a>\u201d contributes to reduced visibility, particularly for those driving lower vehicles. Higher off the ground, the light\u2019s direction can aim \u201cdirectly at the other drivers\u2019 line of sight.\u201d Secondly, bright LEDs piercing through the windshield of an oncoming vehicle can harm more than just other drivers. Sometimes confusing the bright headlights for high beams, in a misguided effort to indicate the perceived error, \u201concoming drivers often <a href=\"https:\/\/www.uscourts.gov\/forms-rules\/about-rulemaking-process\"><em>flash their own high beams<\/em><\/a>.\u201d As a result, both drivers wind up sightless, driving directly towards one another down a dark road.<\/p>\n\n\n\n<p>For those desperately seeking any semblance of relief from bright, blinding headlights: certain vehicle modifications can reduce glare. Firstly, maintaining a clean windshield, or installing <a href=\"https:\/\/www.freep.com\/story\/news\/local\/michigan\/2025\/02\/05\/led-headlights-blind-drivers-glare-michigan\/78213162007\/\"><em>anti-glare film<\/em><\/a> can help reduce glare from oncoming vehicles. Drivers can also reduce glare from vehicles in the rear view \u201c[i]n some vehicles, drivers can pull a lever under their rearview mirror to activate a night setting or \u201cdrivers can adjust their side mirrors down.\u201d<\/p>\n\n\n\n<p>Such solutions often fall short of satisfying\u2014only providing minor relief from brutally blind headlights. Accordingly, more comprehensive and further-reaching solutions are necessary. For starters, the National Highway Traffic Safety Administration, responsible for setting headlight brightness requirements, does not impose \u201can <a href=\"https:\/\/www.washingtontimes.com\/news\/2025\/may\/23\/blinded-light-house-lawmaker-wants-congress-cut-led-glare-car\/\"><em>overall limit<\/em><\/a> on low-beam headlight brightness.\u201d Currently, <a href=\"https:\/\/www.softlights.org\/wp-content\/uploads\/2024\/03\/NHTSA-Petition-to-Limit-Headlight-Intensity.pdf\"><em>numerous test points<\/em><\/a> for maximum headlight intensity have an infinite limit. As certain locations\u2014including the middle of the headlight\u2014lack limits completely, intensity limits do not regulate the headlight\u2019s brightness in its entirety allowing for greater glare.<\/p>\n\n\n\n<p>Albeit, an NHTSA spokesperson stated the agency recently received a <a href=\"https:\/\/www.wsj.com\/lifestyle\/car-led-headlights-too-bright-safety-driving-df0dd05e?gaa_at=eafs&amp;gaa_n=AWEtsqcQ8pMb9MfKY04J_jul49lNBSlGuTRZeNOj8p7EPFs6jdEBxbmrBpWJ4sj5nUY%3D&amp;gaa_ts=690e89d2&amp;gaa_sig=X4o90MQjcVb8Zf3Oj-8htMaF_Xu9H5vnsG9R31qIGwbywmvSN92gnLw1a1q-DOD_WgrqEOIII62n2rvIL5JGew%3D%3D\"><em>rule-making<\/em><\/a> petition, requestion the Agency consider setting an overall limit on the maximum brightness of low beam headlights\u2014suggesting \u201c<a href=\"https:\/\/www.softlights.org\/wp-content\/uploads\/2024\/03\/NHTSA-Petition-to-Limit-Headlight-Intensity.pdf\"><em>20,000 candelas<\/em><\/a>, or another value the NHTSA determines ensures the comfort, health, safety, and civil rights of any oncoming driver, pedestrian, bicyclist, wheelchair user, child, and all others,\u201d while meeting federal requirements for protecting photobiological, neurological, psychological, and hormonal safety for Visible Light radiation emitted by an electronic product. However, the rule-making process can take <a href=\"https:\/\/www.uscourts.gov\/forms-rules\/about-rulemaking-process\"><em>two to three years<\/em><\/a><em> <\/em>before a suggestion is enacted as a rule. For instance, the NHTSA\u2019s (soon to be discussed) 2024 adaptive headlight rule-making originally arose from <a href=\"https:\/\/www.nhtsa.gov\/sites\/nhtsa.gov\/files\/2022-02\/ADB-Final-Rule-02-01-2022-web.pdf\"><em>Toyota\u2019s 2013 petition<\/em><\/a> requesting the option to equip vehicles with adaptive headlight systems.<\/p>\n\n\n\n<p>However, a maximum brightness limit alone may not be the only solution. As the NHTSA notes, visibility and glare prevention are \u201c<a href=\"https:\/\/www.nhtsa.gov\/sites\/nhtsa.gov\/files\/2022-02\/ADB-Final-Rule-02-01-2022-web.pdf\"><em>twin safety needs<\/em><\/a>.\u201d Accordingly, harvesting as much as the increased visibility benefits of LEDs as possible while reducing glare for other drivers is the ideal. In many ways, the adaptive driving beam headlights other countries have offered <a href=\"https:\/\/edition.cnn.com\/2024\/02\/15\/cars\/headlights-tech-adaptable-high-beams-cars\"><em>for many years<\/em><\/a> provide just that. Keeping high beams on at all times, <a href=\"https:\/\/plus.lexis.com\/api\/permalink\/e6175097-b89e-4eb1-9240-7445bcf19d52\/?context=1530671\"><em>the headlight\u2019s internal sensors<\/em><\/a> redirect light and decrease glare, \u201c<a href=\"https:\/\/edition.cnn.com\/2024\/02\/15\/cars\/headlights-tech-adaptable-high-beams-cars\"><em>shap[ing] the light<\/em><\/a>\u2026rather than scattering it.\u201d In doing so, the headlights still cover the road with a bright light, while creating \u201ca pocket of dimmer light around the other vehicles.\u201d As such, the driver retains a well-illuminated field of vision <a href=\"https:\/\/www.nhtsa.gov\/press-releases\/nhtsa-allow-adaptive-driving-beam-headlights-new-vehicles-improving-safety-drivers\"><em>without blinding other drivers<\/em><\/a>.<\/p>\n\n\n\n<p>Although the NHTSA finally approved <a href=\"https:\/\/www.nhtsa.gov\/press-releases\/nhtsa-allow-adaptive-driving-beam-headlights-new-vehicles-improving-safety-drivers\"><em>adaptive headlights<\/em><\/a> in 2022, the technology <a href=\"https:\/\/edition.cnn.com\/2024\/02\/15\/cars\/headlights-tech-adaptable-high-beams-cars\"><em>has yet to emerge on the American market<\/em><\/a>\u2014well, not in functioning form, that is. Oddly enough, some American cars are in fact equipped with adaptive headlights\u2014but due to the differences in the NHTSA\u2019s regulations, \u201c<a href=\"https:\/\/edition.cnn.com\/2024\/02\/15\/cars\/headlights-tech-adaptable-high-beams-cars\"><em>lack the software<\/em><\/a>\u201d for activation. However, some consumers are already starting to face confusion in the marketplace. In <em>Shu v. Toyota<\/em>, for instance, four Toyota RAV-4 purchasers filed a fraud complaint, alleging the accusedcar manufacturer provided written documentation indicating the RAV-4 <a href=\"https:\/\/plus.lexis.com\/api\/permalink\/fd321719-1924-40fc-afe2-43a3624ad5c3\/?context=1530671\"><em>premium package<\/em><\/a> included adaptive headlights. Despite the feature\u2019s absence from the vehicle, the plaintiffs cited marketing materials\u2014ranging from brochures to website offerings. Dismissing the question on procedural grounds, the case gives reason to believe the regulatory gap may compromise consumers purchasing experience. Considering the expansion of advertising beyond geographical limits of local airwaves, and the added element of influencer marketing, companies have significantly less control over which materials consumers view.<\/p>\n\n\n\n<p>This is largely a result of the NHTSA rulemaking setting forth requirements differing from those in other countries. Refusing to directly importthe <a href=\"https:\/\/www.nhtsa.gov\/sites\/nhtsa.gov\/files\/2022-02\/ADB-Final-Rule-02-01-2022-web.pdf\"><em>Economic Commission for Europe\u2019s<\/em><\/a> regulations, according to the NHTSA<strong>,<\/strong> the European model\u2019s road test inappropriate due to the testing the systems on various types of roads, at various speeds, in various specified traffic conditions produced subjective observations. In the U.S., instead of receiving blanket approval for certain product types, manufacturers must <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/49\/30115\"><em>self-certify<\/em><\/a> compliance. Accordingly, the Agency\u2019sdescribedtests must be capable of consistently producing the same results. Instead, the NHTSA opted for track-test scenarios.<\/p>\n\n\n\n<p>However, numerous major car manufacturing companies\u2014including Toyota, Honda, Volkswagen, GM, and Ford\u2014critiqued the proposed track test impracticability, with Toyota estimating \u201cthe proposal resulted in <a href=\"https:\/\/www.nhtsa.gov\/sites\/nhtsa.gov\/files\/2022-02\/ADB-Final-Rule-02-01-2022-web.pdf\"><em>10,000 possible test scenarios<\/em><\/a>,\u201d with several commenters further claiming \u201cthe proposal would necessitate testing capabilities beyond those available at existing testing facilities.\u201d<\/p>\n\n\n\n<p>Moreover, attempting to prioritize glare reduction over all else, exceeding the applicable glare limit for even .01 second constitutes a test failure\u2014intended to ensure any excess glare is whole imperceptible to the human eye. Commenters, however, found this to be overly corrective. Toyota, for instance, commenting on the lack of clear evidence demonstrating the heightened standards \u201cleads to a safety hazard any greater than what occurs with existing headlighting systems on U.S. roads today.\u201d<\/p>\n\n\n\n<p>Considering the added burden of self-certification and the added costs of adapting to a new testing standard while simultaneously updating the technology, automobile manufacturers face an uphill battle in developing sufficient adaptive headlights for American markets.According to <a href=\"https:\/\/edition.cnn.com\/2024\/02\/15\/cars\/headlights-tech-adaptable-high-beams-cars\"><em>auto industry sources<\/em><\/a> speculate the NHTSA\u2019s differentstandards demand years of redesigning efforts\u2014requiring a completely new headlamp designs for the US.\u201d <\/p>\n\n\n\n<p>Whether it be through lobbying the NHTSA to make the adaptive headlight regulations <a href=\"https:\/\/edition.cnn.com\/2024\/02\/15\/cars\/headlights-tech-adaptable-high-beams-cars\"><em>easier and less costly<\/em><\/a>, or <a href=\"https:\/\/www.washingtontimes.com\/news\/2025\/may\/23\/blinded-light-house-lawmaker-wants-congress-cut-led-glare-car\/\"><em>lawmakers pushing<\/em><\/a> for the NHTSA to impose a maximum brightness requirement, the increasingly prevalent difficulties with nighttime driving demand action. The brightness of LED bulbs should make streets safer, not more treacherous. While drivers can alleviate some glare through personal vehicle adjustments, the threatened safety of others demands greater attention. Although a maximum headlight brightness regulation may reduce some glare, ultimately advanced headlight designs which retain increased visibility but do not interfere with the well-being of others is seemingly the best way forward.
